TERMS OF REFERENCE FOR MID TERM REVIEW OF THE PROJECT- CONTINUATION OF STRENGTHENING ACCESS TO JUSTICE AND LEGAL EMPOWERMENT FOR PEOPLE IN NEED IN KENYA FUNDED BY MISEREOR.
PROJECT EVALUATION PERIOD: 1st AUGUST 2022 – 31ST JANUARY 2024
1.0 Background of Continuation of Strengthening Access to Justice and Legal Empowerment for People
Since 1st August 2022, KITUO has been implementing a project dubbed, ‘continuation of strengthening access to justice and legal empowerment for people’ with the generous support of Misereor. The project covers the informal settlements of Nairobi and Mombasa Counties and selected parts of Baringo, Bungoma, Marsabit, Tana River, Isiolo, Turkana, Kisii and Taita Taveta where it has been realized that there has been an increased prevalence of human rights violations.
Access to justice remains a pipe dream for a majority of the poor and marginalized Kenyans who live in these areas. Majority of the population in these areas are in dire need of legal aid and empowerment. The Constitution of Kenya in article 48 recognizes access to justice as a right for all. However, the absence of enabling policy and legislation on access to justice including poverty, high cost of filing fees, inability to afford the services of an advocate, ignorance and limited awareness on human rights continue to prevent deserving persons from accessing and enjoying their rights as enshrined in article 48.
It is against this backdrop that this project seeks to give life to article 48 of the Constitution by promoting access to justice through the legal aid to include legal education, advice and representation and advocacy for the enactment of legislation on legal aid and to enhance citizen participation.
The objectives of the project are as follows:
- To increase the number of poor and marginalized people with improved access to legal protection and legal system.
- To strengthen KITUO’s Volunteer advocates and paralegal scheme.
- To advocate for the enactment of pro-poor policies and laws on Legal Aid.
- To increase citizen participation and advocacy on governance, land, labour and housing issues.
2.0 Purpose of the task
The period of the mid-term review shall be from 25th November 2024 to 13th December 2024. Given this backdrop, it is imperative that an in-depth monitoring exercise of the project is conducted with the object of measuring immediate results and outcomes against the set objectives and documenting lessons and challenges for learning purposes for half of the term of the project. The purpose of this task therefore is to conduct a midterm review of the project as against outcomes and results since inception of the project. The aim of this exercise is to further document lessons, success stories, case studies and challenges emanating from the implementation of the project.
3.0 Scope of the work
The Consultant will be expected to develop a framework detailing how the review process will be conducted, and thereafter meet and work with the project team in the development of various tools that will guide the process. Upon development of the requisite tools, the Consultant will be expected to interview the project beneficiaries and stakeholders through in person and virtual meetings. The Consultant at this stage will receive support from the project staff in undertaking the mid-term evaluation.
4.0 Deliverables.
The key deliverables for this consultancy include:
a. Develop a framework for evaluating the project.
b. Develop tools anchored on the results framework of the project.
c. Interview project beneficiaries and stakeholders and project team.
d. Produce a mid-term evaluation report documenting lessons learnt, success stories, case studies, challenges and recommendations emanating from the implementation of the project from 1st August 2022 to 31st January 2024.
e. Present the report to project staff, stakeholders and beneficiaries for validation.

6.0 Expertise required.
The Consultant should have extensive knowledge and experience on projects and more specifically on the aspect of monitoring, learning and reporting as indicated below:

a) Proven experience Monitoring and Evaluation, RBM and Management Consulting and Capacity building.
b) Excellent communication and writing skills.
c) Ability to support an enabling environment for open communication with stakeholders.
Desired Qualifications
· At least an LLM and or MA degree in Sociology, Development, Statistics or any other relevant field.
Technical Experience Requirements
a) At least 15 years of relevant experience in M&E, RBM, Strategic Planning and M&E related capacity building.
b) Good experience in delivering training on M&E and data analysis.
c) Experience in qualitative and quantitative research.
d) Good background in M&E advising in donor-funded programs.
9.0 Project Monitoring period.
The midterm monitoring exercise will cover the period from 1st August 2022 – 31st January 2024.
10.0 Payment.
The total costs for the assignment will be KShs of 300, 000 only inclusive of withholding tax. This payment shall be made by way of Cheque. Consultancy fees will be paid as follows: –
- 30% on delivery of inception report
- 40% on presentation of draft report
- 30% on submission of final report and final knowledge products
11.0 Reporting and Supervision
The consultant(s) will report to the Executive Director of Kituo Cha Sheria and will work closely with the project team in Head Office and the Mombasa Office to ensure alignment with the objectives and scope of the assessment. The organization will cater for the logistical costs for the Consultant to undertake the assignment.
